1. Introduction & Platform Description
Welcome to Victtory, a global sports technology platform designed to empower aspiring athletes, scouts, agents, coaches, and clubs. Our mission is to provide athletes with the visibility, tools, and connections they need to build their careers and get discovered by professionals.
Victtory allows users to create dynamic, verified profiles that showcase their skills and achievements. The platform also provides scouting tools, athlete recruitment opportunities, and brand sponsorship connections. Initially focusing on football, Victtory will expand to other sports, including cricket, basketball, and more.
By accessing or using Victtory (including our website, mobile app, and related services), you agree to comply with these Terms & Conditions, as well as any future updates or modifications. Please read these terms carefully before using our platform.
2. Eligibility
Minimum Age: You must be at least 13 years old to use the Victtory platform. If you are under 18, you must obtain consent from a parent or guardian to use the platform.
Parental Consent for Minors: Users under the age of 18 must have their parent or guardian provide explicit consent for data collection and use. Parents and guardians are responsible for supervising the minor’s use of the platform and ensuring that the minor adheres to these Terms & Conditions.
3. User Responsibilities & Content Guidelines
By using Victtory, you agree to the following responsibilities:
Profile Information: You are responsible for maintaining the accuracy of the information you provide on your profile. Any false, misleading, or incomplete information may result in the suspension or termination of your account.
Content Upload: You retain ownership of the content you upload, such as photos, videos, performance statistics, etc. However, by submitting content to Victtory, you grant us a non-exclusive, royalty-free, transferable license to use, display, and promote your content on the platform for its intended purposes.
Prohibited Activities: You agree to refrain from engaging in:
Hate speech, discrimination, or harassment.
Impersonation of other users or entities.
Creating fake profiles or submitting false information.
Posting illegal, offensive, obscene, or harmful content.
Spamming or using the platform for unsolicited advertising.
Content Removal: Victtory reserves the right to remove any content that violates these Terms & Conditions or is deemed harmful or inappropriate. We also reserve the right to suspend, block, or terminate user accounts engaging in prohibited activities.
4. Intellectual Property Rights
User-Uploaded Content: You retain ownership of the content you upload to Victtory, such as photos, videos, and performance data. However, by submitting this content, you grant Victtory a non-exclusive, royalty-free, transferable license to use, display, and promote your content on the platform for its intended purposes.
Victtory’s Intellectual Property: All intellectual property rights associated with Victtory, including its logo, trademarks, platform design, and any other proprietary materials, remain exclusively with Victtory Holding. Users may not use or reproduce these materials without express written consent from Victtory.
5. Termination Clause
Victtory reserves the right to suspend or terminate your account if:
You violate these Terms & Conditions or engage in prohibited activities.
Your profile contains false, misleading, or incomplete information.
You misuse or abuse the platform in a way that violates other users’ rights or the integrity of the platform.
Termination may be permanent or temporary, depending on the severity of the violation. You may also terminate your account at any time by following the appropriate procedure in your account settings.
6. Governing Law & Dispute Resolution
Governing Law: These Terms & Conditions are governed by the laws of Dubai, UAE.
Dispute Resolution: If any dispute arises from your use of Victtory, we encourage you to contact us to resolve the issue amicably. If the dispute cannot be resolved informally, the parties agree to submit to binding arbitration in Dubai, under the rules of the Dubai International Arbitration Centre (DIAC). Arbitration shall be conducted in English, and the decision rendered will be final and binding.
7. Data Protection & Privacy
Victtory is committed to protecting your privacy in compliance with applicable data protection laws, including GDPR (General Data Protection Regulation), CCPA (California Consumer Privacy Act), and others. The collection and use of your personal data are governed by our Privacy Policy.
8. Payment Terms (Freemium SaaS Model)
Freemium Model: Victtory operates on a freemium model, where basic profile creation and access to some features are free. Premium features, such as custom CV templates, enhanced visibility, and detailed analytics, are available through paid subscriptions.
Subscription Plans: Premium plans are available on a monthly or annual basis. The prices and terms for these plans will be clearly displayed before you subscribe.
No Job Guarantee: While Victtory provides exposure and facilitates connections, we do not guarantee that any user will be hired, selected for trials, or offered employment. All final decisions regarding recruitment, job offers, or trials rest with third-party recruiters, clubs, and agents.
9. Limitation of Liability
Victtory is a platform for showcasing athlete profiles, facilitating connections, and enhancing visibility within the sports industry. We are not responsible for any recruitment, job offers, or employment opportunities that may or may not arise from interactions on the platform.
Victtory is not liable for any transactions, agreements, or disputes that occur outside of the platform, including job offers, agent commissions, contracts, and any injuries resulting from activities arranged through the platform.
10. Third-Party Integrations
AI Features & APIs: Victtory may integrate third-party services and APIs, such as artificial intelligence features for matchmaking, analytics, and video verification. These services will operate according to their respective terms and policies, which you agree to comply with when using these features.
Payment & Video Verification Services: Victtory may integrate with third-party payment processors and video verification services. By using these services, you agree to the terms of service and privacy policies of the respective third-party providers.
11. Social Media Use & User-Generated Content
Social Media: By using Victtory, you grant us permission to share your content on social media channels associated with the platform, including Instagram, LinkedIn, and Twitter. You retain ownership of your content, but you agree that Victtory may use your content for promotional purposes related to the platform.
12. User Feedback, Suggestions, and Ideas
Feedback: By providing feedback or suggestions about the Victtory platform, you grant Victtory a perpetual, worldwide, royalty-free, and irrevocable license to use such feedback or suggestions for any purpose without compensation to you.
13. Force Majeure Clause
Victtory shall not be liable for failure or delay in the performance of its obligations under these Terms & Conditions due to events beyond its reasonable control, including but not limited to acts of God, war, terrorism, strikes, civil unrest, government actions, natural disasters, or technical failures.
14. Data Retention Policy
Victtory will retain your personal data and profile information for as long as your account remains active or as necessary to provide the platform’s services. If you wish to delete your account or have your data removed, you may contact us directly or follow the procedure outlined in the Privacy Policy.
15. Governing Language
The governing language of these Terms & Conditions is English. In the event of any conflict between translations, the English version shall prevail.
16. Severability Clause
If any provision of these Terms & Conditions is determined to be unlawful, void, or unenforceable, the remaining provisions will continue in full force and effect.
17. No Agency or Partnership
Nothing in these Terms & Conditions creates an agency, partnership, joint venture, or employment relationship between the user and Victtory. The user is an independent contractor, and nothing in this agreement shall be interpreted as creating any other relationship.
18. Subscription and Billing Disputes
In case of any disputes regarding billing or payments for premium subscriptions, users must contact Victtory support within 30 days of the charge. We will address the dispute within a reasonable timeframe, but we do not guarantee any refund or reimbursement outside of our stated refund policy.
19. User-Generated Content Guidelines
Users must ensure that their content follows the platform’s guidelines, which prohibit the posting of content that:
Violates any laws or regulations
Infringes on any third-party rights (including intellectual property)
Contains hate speech, harassment, or harmful content
Promotes illegal or harmful activities
Is deceptive or misleading
20. Third-Party Liability
Victtory is not responsible for the actions or inactions of third-party services, including payment processors, video verification services, and other integrations. Users acknowledge that they interact with these third parties at their own risk, and any issues arising from third-party services should be resolved directly with the respective third party.
21. Term of Agreement / Duration of Use
This agreement will remain in effect until terminated by either party. Users may terminate their accounts at any time by following the instructions in the platform. Victtory reserves the right to suspend or terminate user accounts in the event of a breach of these Terms & Conditions.
